Activists Seek to Recall OC Judge

Could a recall move against OC's judiciary might set a bad legal precedent?

Late last week, activists announced they had filed papers for a recall against Orange County Superior Court Judge M. Mark Kelley. He had drawn national scorn in April for handing down a lighter sentence against a man convicted of sexually assaulting a three-year-old, arguing "there was no violence or callous disregard for (the victim's) well-being." His ruling drew rebukes not only from activists but also politicians and the OC district attorney's office, which vows to appeal the ruling. While OC has no lack of controversial judges over the years, this is the first time in recent memory that a recall has been sought against one. Will the recall against Judge Kelley be successful -- but if so, will a dangerous legal precedent be set?
