By a 5-4 margin, the justices upheld a lower court ruling that the Texas Department of Housing and Community Affairs had violated the Fair Housing Act of 1968. A fair housing group had sued this Texas Department, claiming they were allocating federal tax credits to build low-income housing -- except in white neighborhoods.
